Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs access to and use of products and services provided by Hops AI Inc. (“Hops,” “We,” “Us,” or “Our”), including Our hosted or downloadable software, applications, AI agents, workspaces, integrations, automations, Models, and related services.

This AUP forms part of the Hops Terms of Service (“Terms”). It also applies under any separate written agreement that incorporates this AUP.

Capitalized terms not defined in this AUP have the meanings given in the Terms. This AUP applies to Account Owners, Authorized Users, Organizations, and anyone who accesses or uses the Services.

If this AUP conflicts with the Terms, the Terms control. Applicable provider requirements may impose additional restrictions on the use of particular Models, integrations, or third-party services.

1. Purpose and Scope.

This AUP establishes requirements for the lawful, secure, responsible, and fair use of the Services. You are responsible for Your use of the Services and for activity conducted through Your Account. Account Owners and Organizations are also responsible for their Authorized Users, permissions, Spaces, integrations, Hops, and automations. Nothing in this AUP limits any other restriction or obligation contained in the Terms.

2. Prohibited Content and Activities.

2.1 Illegal or Harmful Activities

You may not use the Services to:

a. Violate applicable law or the legal rights of any person;

b. Encourage, facilitate, or assist criminal or unlawful conduct;

c. Promote or facilitate violence, violent extremism, terrorism, or hateful conduct;

d. Develop, acquire, or deploy weapons, explosives, or dangerous materials for harmful purposes;

e. Compromise or disrupt critical infrastructure, communications, medical systems, financial systems, or public services;

f. Facilitate human trafficking, sexual exploitation, or the unlawful sale of regulated goods or services;

g. Facilitate suicide, self-harm, eating disorders, sexual violence, or non-consensual intimate imagery; or

h. Create or distribute content that is unlawful, threatening, defamatory, or intended to cause material harm.

2.2 Child Safety

You may not use the Services to create, request, store, distribute, or facilitate:

a. Child sexual abuse material, including AI-generated material;

b. Grooming, sexualization, exploitation, or trafficking of minors;

c. Content intended to facilitate child abuse or conceal such abuse; or

d. Age-inappropriate sexual or violent interactions involving minors.

We may report suspected child exploitation to applicable authorities or reporting organizations.

2.3 Fraud, Deception, Harassment, and Spam

You may not use the Services to:

a. Commit or facilitate fraud, scams, phishing, identity theft, or social engineering;

b. Impersonate another person or Organization without authorization;

c. Misrepresent the source, authenticity, or provenance of content in a deceptive manner;

d. Generate or distribute fake reviews, fabricated credentials, or deceptive business communications;

e. Harass, threaten, bully, intimidate, stalk, or coordinate abuse against another person;

f. Generate or distribute spam or unsolicited communications in violation of applicable law or recipient preferences;

g. Manipulate individuals through deceptive techniques that materially impair informed decision-making;

h. Conceal the use of AI where disclosure is required by law, provider requirements, or the context of the communication; or

i. Interfere with elections or democratic processes through deception, voter suppression, fabricated political content, coordinated inauthentic behavior, or undisclosed automated influence campaigns.

2.4 Privacy and Sensitive Data

You may not use the Services to:

a. Collect, access, disclose, monitor, or use personal information without appropriate authority;

b. Track or surveil individuals without required notice, consent, or lawful authority;

c. Create or expand facial-recognition databases through untargeted scraping of images;

d. Conduct real-time remote biometric identification where prohibited by applicable law;

e. Categorize individuals using biometric data to infer protected or sensitive characteristics;

f. Infer emotions in workplaces or educational institutions, except where lawfully permitted for medical or safety purposes;

g. Predict an individual’s risk of criminal conduct based solely on profiling or personal characteristics;

h. Profile or socially score individuals in a manner that results in unlawful, disproportionate, or unjustified treatment;

i. Submit Sensitive Data unless expressly permitted through the Services, Order Terms, or other written authorization from Hops;

j. Expose credentials, API keys, passwords, tokens, private keys, or secrets outside designated credential or integration workflows; or

k. Make, recommend, or materially influence decisions that unlawfully discriminate against an individual based on a protected characteristic.

2.5 Security, Malware, and Unauthorized Access

You may not use the Services to:

a. Create, distribute, or deploy malware, ransomware, viruses, keyloggers, botnets, backdoors, or destructive code;

b. Access or attempt to access systems, accounts, networks, devices, or data without authorization;

c. Identify or exploit vulnerabilities without authorization from the applicable system owner;

d. Conduct penetration testing, vulnerability scanning, or security testing without required authorization;

e. Conduct denial-of-service attacks or materially disrupt systems or networks;

f. Bypass authentication, permissions, safety controls, filters, rate limits, or technical restrictions;

g. Extract, override, or manipulate system prompts, safety instructions, or model controls through prompt injection or jailbreaking; or

h. Insert malicious instructions into content intended to manipulate a Hop, Model, integration, or automated workflow.

Legitimate security research must have appropriate authorization and comply with applicable law.

2.6 Intellectual Property and Competitive Misuse

You may not use the Services to:

a. Infringe, misappropriate, or violate intellectual property, privacy, publicity, or contractual rights;

b. Reproduce proprietary materials without appropriate rights or authorization;

c. Scrape, distill, or systematically extract Models, Output, model behavior, prompts, or preferences;

d. Use the Services or Output to train or improve a competing AI model or service without Our written authorization;

e. Benchmark the Services for publication or commercial use without Our written authorization;

f. Copy or use Our features, interfaces, workflows, or other technology to build a competing service; or

g. Remove or alter proprietary notices, attribution, or license information.

2.7 Human Review

All Output is intended as assistance or guidance and may contain errors, omissions, inaccuracies, bias, insecure content, or third-party materials. You must review, test, and validate Output before relying on it, using it in production, disclosing or distributing it externally, or using it to take a material action.

You must assess Output for accuracy, completeness, security, legality, appropriateness, and applicable intellectual property or license obligations. If You configure the Services to act automatically, You remain responsible for implementing appropriate safeguards, testing, permissions, monitoring, and approval thresholds.

You remain solely responsible for all Output that You use, approve, execute, publish, deploy, disclose, or distribute.

2.8 High-Impact Uses

You may not use the Services to make fully automated decisions that determine an individual’s legal rights, eligibility, access, safety, or material opportunities in:

a. Employment or housing;

b. Credit, lending, insurance, or financial services;

c. Healthcare or medical treatment;

d. Education, admissions, or testing;

e. Legal services or access to essential government services; or

f. Criminal justice, law enforcement, or immigration.

Where Output materially informs a decision in these areas, an appropriately qualified human must independently review the Output before the decision is finalized.

You remain responsible for determining whether additional notices, consents, assessments, safeguards, explanations, or human oversight are required by applicable law.

2.9 AI Transparency and Content Marking

The Services may add or preserve machine-readable watermarks, content credentials, provenance metadata, labels, or other signals indicating that content was generated or modified using AI. You may not intentionally remove, alter, disable, or circumvent such measures to conceal AI involvement or evade applicable law or provider requirements.

The Services may display, transmit, or otherwise provide notices that a person is interacting with AI. You may not remove, obscure, disable, or circumvent those notices.

If You integrate the Services into an interface or communication channel that You control, You must implement and preserve any AI-interaction disclosure mechanism specified in the Services or Our documentation. When You publish, distribute, or use Output externally, You are responsible for providing any disclosure required by applicable law, including disclosures concerning deepfakes and AI-generated text published on matters of public interest.

3. Service Integrity and Fair Use.

3.1 Fair and Reasonable Use

The Services are subject to the Usage Limits described in the Terms, Services, Account Page, documentation, or applicable Order Terms. You must use the Services fairly and consistently with the intended operation of Your Account type, plan, features, integrations, and entitlements.

We may consider usage volume, frequency, duration, storage, compute resources, automation activity, integration activity, users, Spaces, costs, and effects on other users.

3.2 Circumvention and Account Abuse

You may not:

a. Circumvent, reset, avoid, or artificially extend Usage Limits;

b. Use duplicate Accounts, Organizations, Spaces, identities, credentials, devices, domains, or payment methods to avoid restrictions;

c. Pool or share credentials, credits, seats, tokens, or entitlements beyond the applicable plan;

d. Automate Account creation or create Accounts using false, misleading, temporary, or unverifiable information;

e. Continue using the Services through another Account after suspension or termination; or

f. Exploit promotions, model routing, multipliers, or plan structures to obtain unintended capacity or benefits.

3.3 Infrastructure and Storage Abuse

You may not:

a. Use the Services in a manner that unreasonably burdens or degrades Our infrastructure;

b. Initiate excessive concurrent sessions, requests, automations, integrations, or model calls;

c. Use the Services primarily for bulk storage, file hosting, archiving, or content delivery outside their intended purposes;

d. Deliberately generate unnecessary activity or consumption without a legitimate use;

e. Use the Services as a proxy or passthrough to access underlying Models or third-party services outside intended Hops functionality; or

f. Resell, sublicense, rent, lease, time-share, or commercially provide the Services without Our written authorization.

4. Hops, Automations, and Integrations.

You may not use a Hop, automation, integration, or connected tool to:

  1. Access data or systems beyond the permissions granted by the applicable owner;
  2. Send external communications without appropriate authorization and required review;
  3. Modify third-party systems, records, documents, tables, or files without appropriate authorization;
  4. Execute transactions or other sensitive actions without required approvals;
  5. Circumvent approval flows, audit logs, permission settings, or human-review requirements;
  6. Conceal or misrepresent the source of an automated action; or
  7. Cause Hops or another provider to violate applicable law or contractual obligations.

You are responsible for configuring and monitoring Your permissions, integrations, approval flows, and automations.

If You connect Your own third-party account or credentials, You must comply with the agreement governing that third-party service.

5. Third-Party Provider Requirements.

The Services may include access to Models and other services supplied by third-party providers.

Provider Requirements” means the then-current acceptable-use, safety, content, geographic, attribution, transparency, watermarking, output-use, and other requirements that We identify or make available in this AUP, the Services, or Our documentation. Provider Requirements include disclosed requirements that a provider requires Hops to pass through to users or enforce.

Your use of each Model or provider service must comply with the applicable Provider Requirements. Depending on the Models available through Your Account, Provider Requirements may include:

  1. Anthropic Models: Anthropic Usage Policy and Anthropic Supported Regions Policy.
  2. OpenAI Models: OpenAI Usage Policies.
  3. Google Models: Google Generative AI Prohibited Use Policy.
  4. SpaceXAI Models: SpaceXAI Acceptable Use Policy.

Other Provider Requirements may be identified in the Services or Our documentation.

Provider Requirements apply only to Your use of the applicable Model or provider service. They may restrict the use of Output for model training, require disclosure of AI involvement, prohibit removing watermarks or provenance information, or impose other use restrictions.

Provider Requirements may change independently of this AUP. If this AUP conflicts with applicable Provider Requirements, the more restrictive requirement will control solely for Your use of the applicable Model or provider service.

You may not use the Services in a manner that causes Hops to violate its obligations to a provider. We may limit, disable, replace, or reroute access where reasonably necessary to comply with Provider Requirements.

A violation of applicable Provider Requirements constitutes a violation of this AUP.

6. Monitoring and Enforcement.

We may monitor usage patterns, safety signals, technical activity, and suspected violations to protect the Services and enforce this AUP.

We may take one or more of the following actions:

  1. Issue a warning or request corrective action;
  2. Block or modify Input or Output;
  3. Impose or adjust Usage Limits;
  4. Throttle, delay, or queue activity;
  5. Restrict a feature, Model, Hop, integration, Space, or automation;
  6. Require verification or additional safeguards;
  7. Suspend or terminate access to all or part of the Services;
  8. Preserve or disclose information where required or permitted by applicable law; or
  9. Report suspected unlawful activity to appropriate authorities.

These actions are in addition to any other rights or remedies available under the Terms, at law, or in equity. We are not required to follow any particular sequence before exercising any available right or remedy.

In cases of willful or deliberate circumvention of security controls, Usage Limits, or other technical measures, We may recover reasonable direct costs incurred as a result. These costs may include excess provider fees, infrastructure costs, and investigation, remediation, or restoration expenses.

7. Updates.

We may update this AUP in accordance with Section 10.4 of the Terms. The current version will be available at https://www.hops.ai/legal/acceptable-use-policy.
